SHERMAN – Siebman, Forrest, Burg & Smith recently helped firm client DePuy Synthes Sales Inc., a unit of New Jersey-based Johnson & Johnson, settle a noncompete lawsuit against Texas-based Orthofix Medical Inc.
Siebman Forrest co-founder Clyde Siebman and firm partner Elizabeth Forrest successfully represented medical device manufacturer DePuy along with attorneys from the Philadelphia-based law firm Blank Rome LLP.
The lawsuit was filed in the Sherman division of the U.S. District Court for the Eastern District of Texas in March 2019 based on claims that Orthofix enticed four different DePuy sales associates to violate their noncompete agreements. The alleged scheme involved DePuy employees in Texas and Alabama convincing the company’s customers to buy Orthofix products instead. DePuy claimed that the scheme cost the company millions of dollars.
The terms of the settlement were not disclosed.
